TERMS & CONDITIONS

Welcome to ART▪︎D▪︎FUSION. These Terms & Conditions ("Terms") govern your access to and use of our website (to be operated under artdfusion.in or artdfusion.com) and the purchase of products offered by us. By accessing our website, placing an order, or engaging with our services, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. ABOUT THE BRAND

ART▪︎D▪︎FUSION is a sole proprietorship business operating from Dhanbad, Jharkhand, India. We specialize in the design, manufacturing, and sale of decorative wall décor products, including but not limited to:

  • Acrylic Wall Arts
  • Acrylic Wall Clocks
  • UV Printed and Non-UV Printed Products

Our products may include ready-made designs as well as customized or made-to-order creations.

2. ELIGIBILITY TO USE

By using our website, you confirm that:

  • You are legally capable of entering into a binding contract under Indian law
  • The information you provide is accurate, complete, and up to date
  • You will use the website and services only for lawful purposes

3. PRODUCTS & CUSTOM ORDERS

3.1 Ready-Made Products

Ready-made products are designs listed directly on our website and available for purchase without customization.

3.2 Customized / Made-to-Order Products

Customized projects are handled through:

  • Project enquiry forms available on the website, or
  • Direct communication via phone or WhatsApp

During the discussion and design finalization stage, we may share references, mockups, demos, or technical details as required. Customers are free to cancel the project during this discussion stage.

Once the customer provides final approval and the production process has started, the order becomes non-cancellable and non-refundable, except in cases specifically mentioned under our Returns & Refunds policy.

4. PRICING, TAXES & PAYMENTS

  • All prices displayed on the website are in Indian Rupees (INR) and are inclusive of GST, unless stated otherwise.
  • We reserve the right to revise product prices, offers, or charges at any time without prior notice.
  • We accept all major payment methods including UPI, Credit/Debit Cards, Net Banking, Wallets, and Cash on Delivery (COD).

5. SHIPPING & DELIVERY

  • We currently ship Pan India.
  • Dispatch Time: 5–7 business days after order confirmation.
  • Delivery Time: 5–7 business days after dispatch. Delivery timelines may vary depending on location, courier partner performance, weather conditions, festivals, or other unforeseen factors.
  • ART▪︎D▪︎FUSION shall not be held liable for delays caused due to circumstances beyond our control.

6. RETURNS, REPLACEMENTS & REFUNDS

6.1 Return Eligibility

A. Ready-Made Products

  • Returns are accepted within 3 days from the date of delivery, provided that:
  • The product is unused
  • The product is returned in the same condition as delivered
  • The return request is supported with clear images and a valid reason

B. Customized Products
Returns for customized orders are accepted only in the following cases:

  • Product damaged during transit
  • Wrong product delivered
  • Manufacturing defect

No returns or refunds will be accepted for customized products for reasons related to personal preference, design approval, or change of mind.

6.2 Reporting a Return

  • All return or replacement requests must be raised within 3 days of delivery.
  • Customers must email clear product images along with a valid reason for return.
  • ART▪︎D▪︎FUSION reserves the sole right to approve or reject any return request.

If the reason provided is found to be invalid or the product appears intentionally damaged, the return request will be rejected and the company may take legal action if required.

6.3 Refund Process

  • Prepaid Orders: Refunds will be processed to the original payment method.
  • COD Orders: Customers must provide valid bank details for refund processing.

Once a return request is approved, customers will receive an email allowing them to choose between:

  • Replacement of the product, or
  • Proceeding with the return and refund

Refunds for cancelled orders initiated by the company will be processed within 72 hours from the date of cancellation.

7. PRODUCT HANDLING & INSTALLATION

  • Minor variations in color, finish, or print output may occur due to screen calibration, UV printing processes, or material properties.
  • Size tolerances of a few millimeters are considered industry standard.
  • Wall mounting and installation are the customer’s responsibility.
  • We provide mounting screws and necessary accessories; however, any damage caused during or after installation will not be covered.

Any damage occurring after the 3-day return/replacement window shall be borne entirely by the customer.

8. INTELLECTUAL PROPERTY RIGHTS

  • Not all designs displayed on the website are exclusive to ART▪︎D▪︎FUSION.
  • Designs may include a mix of original creations, licensed/free-source designs, and reference-based interpretations.
  • No commercial usage rights are granted for any designs, images, or content available on our website.

If customers use any website content for personal purposes and face legal issues or third-party claims, ART▪︎D▪︎FUSION shall not be held responsible.

9. USER CONDUCT

  • Users are strictly prohibited from:
  • Uploading offensive, abusive, illegal, or copyrighted material
  • Misusing website content or attempting fraud
  • Initiating false chargebacks or disputes

We reserve the right to cancel orders, suspend services, or take legal action if any such misuse is identified.

10. ORDER CANCELLATION BY COMPANY

ART▪︎D▪︎FUSION reserves the right to cancel any order at its sole discretion due to reasons including but not limited to:

  • Incorrect or incomplete address
  • Payment issues
  • Inappropriate or illegal customization requests
  • Operational constraints

In such cases, prepaid order refunds will be processed within 72 hours.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • ART▪︎D▪︎FUSION shall not be liable for indirect, incidental, or consequential damages
  • Liability shall not exceed the value of the product purchased

12. GOVERNING LAW & JURISDICTION

These Terms shall be governed and interpreted in accordance with the laws of India. Any disputes shall be subject to the jurisdiction of competent courts in Dhanbad, Jharkhand.
